Some readers of the THREE form have questioned whether THREE covers the policyholder for hired, non-owned autos (because they don’t see the typical language detailing the aspects of that issue). In fact, THREE does cover hired/ non-owned autos: such an auto can create a liability exposure for the insured. THREE plainly and openly covers the business’s liability to others. While THREE excludes autos that are leased or owned but not scheduled, the exclusion says nothing about hired or borrowed autos. This is obvious if one accepts the plain stated liability coverage section of THREE (less so if one gets caught up looking for provisions about hired, non-owned autos that are not necessary in THREE given how it works). The narrow wording of this exclusion is also why THREE includes coverage for hired/non-owed auto even when the policy has no listed vehicles.
